Environmental Litigation before the ICJ: How effective can it be?

In his presentation Edgardo will provide a brief overview of the environmental cases that have been before the ICJ. He will then discuss the effectiveness of the ICJ in environmental litigation by focusing on three aspects: evidence, provisional measures, and the role of the Court in the development of international environmental law.

Edgardo Sobenes (Adv. LL.M., Msc) is an international lawyer with extensive experience in international litigation before the International Court of Justice and a unique practice in coordinating and managing international legal teams. As an international lawyer, Edgardo has provided legal counselling and assistance in several inter-state cases before the ICJ on issues concerning state responsibility, use of force, land and maritime boundary delimitation, law of the sea, international water law, the law of treaties, right to self-determination and environmental law. He is also an expert in the preparation of evidence and in the application of innovative techniques. He holds an Advanced LL.M. in Public International Law from the University of Leiden, The Netherlands, and a Master’s Degree in International Law from the Higher Institute of Law and Economics (ISDE) and the University of Barcelona, Spain. He is the founder and President of the Nicaraguan Branch (regional branch) of the International Law Association. Edgardo guest lectures globally on topics related to international law and international litigation and is the author of many publications on issues concerning international law (Cambridge Press, The Max Planck Encyclopedia of International Procedural Law, Springer, T.M.C. Asser Press).
