Justice, Rights and Remedies: Using Oral Traditions to Influence the Right to an Effective Remedy in Scotland
My research examines access to justice via effective remedies for human rights violations in Scotland, with a focus on collective economic, social and cultural (ESC) rights. It critiques the inadequacies of the existing domestic framework, which lacks mechanisms to deliver remedies for ESC rights violations contributing to systemic social injustice that disproportionately impacts marginalised communities. The overarching objective of the research is to influence the right to an effective remedy by contributing to improved understanding and provision of effective remedies in Scotland. An interdisciplinary mixed-methods approach will allow the study to move beyond dominant framings of law and justice and orient it towards potentially liberatory ends: doctrinal analysis will be supplemented by a participatory arts-based ethnographic case study illustrating the human rights issues affecting Gypsy, Roma and Traveller (GRT) communities in Scotland and exploring how these might be effectively remedied.
