Negotiorum gestio is a valuable, but underappreciated, legal concept. It allows one party to administer the affairs of another in situations where that other is incapable of giving consent. There are very few reported cases on negotiorum gestio and, because of this, it is thought to be of marginal interest at best. Yet just because something does not often feature in litigation does not mean that it is practically unimportant. This project, led by Dr Jonathan Brown, seeks to explore the uses to which negotiorum gestio has been put by legal practitioners, hypothesising that the concept may be a useful means of circumventing court action.
