Damages claims in the trucks’ cartel case: lessons learnt from the Spanish experience
The European Commission’s decision on the truck manufacturers’ cartel has revitalised private competition law enforcement across Europe. It has opened the way for private claims - some backed by litigation funders - by potential victims of anti-competitive behaviour by some of the biggest names in motor manufacturing. Spain is one of the EU member states where judges have already issued judgments on several of the legal and economic issues elicited by the damages claims in this case, which involves the manufacturers of nine out of ten medium and heavy trucks sold in Europe.
In this free seminar, Professor Francisco Marcos, of the IE Law School at Madrid University, and a visiting researcher at SCALES, Strathclyde University’s Law School, will discuss the procedural and substantive questions that the Spanish courts have been called upon to decide. The seminar will explore the potential to clarify and resolve a number of issues that will pave the way to future successful litigation in other competition law infringement follow-on contexts.
