Scales Seminar, Economies in Just Transition. The Role of Competition Law

Just transition is understood as a process towards an environmentally sustainable economy, which needs to be well managed and contribute to the goals of decent work for all, social inclusion, and the eradication of poverty. Under such a paradigm, social values (related to the right to work, right to health, right to food etc.), and environmental values (related to a clean environment, biodiversity, and reducing emissions) constitute guiding principles for the economic transition to green economy. For a just transition to succeed, markets need to be shaped in a way that not only their competitive nature is preserved but also that their negative impact on socio-economic and environmental values is curtailed. During the seminar Maciej Bernatt will try to explain what the role of competition law in this context might be. He will do this by positioning national competition laws within national constitutional frameworks of selected transition countries. The tentative proposals made will cover both the substance of competition law and its institutional setting.
